<title>Reyes Transportation: Preventing Tragedy at the Bus Stop</title>

<description><![CDATA[ Connie Chavis assumed her 5-year-old daughter, Brittany, would be safe at her school bus stop. After all, through the window of her mobile home, located about 200 yards from the pickup point, Connie could keep an eye on her daughter until Bus 134 pulled up and whisked the kindergartner off to West Hoke Elementary School in rural North Carolina. Connie's assumption - along with her daughter - died early this year. On Jan. 7, Brittany was kidnapped while she waited for her bus. Connie did not witness the abduction, having interrupted her vigil at the window to go to the bathroom. When she returned, her daughter was gone. She thought the bus had picked her up, but neighbors told her that Brittany had been taken by a man driving a brown pickup truck. A day later, Brittany's lifeless body was discovered in the woods about two miles from her home. Police say she had been sexually molested. At press time, law enforcement agencies were still hunting for Brittany's killer. They had no suspects. nnIs safety an illusion?nnThis incident illustrates the false sense of security that many parents have in allowing young children, especially kindergartners and preschoolers, to walk alone to their bus stops. Many school districts require a parent or guardian to accompany young children to the bus stop and to meet them at the end of the school day as well. But some districts, like the one in Hoke County, N.C., do not. In this case, a tougher policy might have prevented a tragedy. "My opinion is that all parents of kindergartners through second graders, and up to the fourth grade depending on the type of areas they walk, need to be at the stop during loading and unloading times," says Dick Fischer, a school transportation consultant in Aurora, Colo. Otherwise, Fischer says, a jury might be inclined to find a school district negligent in the event of a bus stop abduction. "At the least, there would probably be contributory negligence," he says. "The liability might depend heavily on what protective procedures and policies were in place and how closely they were adhered to." Fischer says it's important that school districts have a written policy on bus stop procedures. "If you don't have written policies and procedures and you don't teach drivers how to follow them, then you can be up a creek without a paddle real fast," he says. For example, what happens if school is closed early and the child will arrive at the bus stop a half hour before the usual time? In a rural area of Ohio, a driver made the mistake of allowing a 7-year-old boy to get off the bus, despite the fact that the boy's father's truck was not in the driveway. The boy told the driver he had a key to the house, although the driver never asked to see it. The boy was later killed when the back window fell and snapped his neck as he tried to enter the house without the key. "It's a perfect example of what can happen if a driver's early and doesn't have written guidelines on how to handle the situation," Fischer says. nnSafety in numbersnnIn San Jose, Calif., police are warning children to walk to school in groups if they're not accompanied by parents. This warning comes in the wake of the kidnapping and sexual assault of a 13-year-old girl who was walking to her bus stop on Feb. 2. The attack left the girl traumatized, but police say her physical injuries were not serious. The assault was the sixth in a recent rash of attacks on young girls, many of whom were abducted while they were walking to meet the bus. Dee Presley, transportation director at San Jose Unified School District, says the school district has responded to the attacks by recommending to parents that they escort their children to the bus stops or have them walk together in groups. "In the 11 or 12 years that I've been here, this is the first time something like this has happened," Presley says. "I've noticed more parents at bus stops lately, which is good." The district does not require parents or guardians to meet kindergartners at the bus stop. "Most kindergartners are met at the bus stop by parents, but you'd be surprised at how many aren't," Presley says. She adds, however, "There are some children that know how to get from the bus stop to their homes, especially if they can see the house from the stop." Some parents have requested their children be moved to alternative bus stops, especially those with a greater number of students. In one case, a change was made after a girl who waited alone for the bus was repeatedly harassed. Presley agreed to move her to a bus stop farther from her home. "I'm not sure it was the best solution," Presley says, "but at least she had some friends at the other stop." Mary Becker, a school bus driver at Westerly (R.I.) School Department, says she has modified a route to accommodate two students who were being harassed before she picked them up on her morning route. "I changed their stops to in front of each house," she says. "In this day and age, you can't be too careful of a child's life and well-being." Like all good drivers, Becker notes suspicious cars or people near the drop-off points and will act with caution if she believes that danger exists. "If there is a way to deliver the students door to door, I will, even if I am late for my next run," she says. "If not, I call a parent to come meet all the students and escort them home. Or I call the police." nnWho's responsible?nn"It's a gray area as to who's responsible for the child between home and the school bus stop," says Jackie Laurie, a spokeswoman for the Ontario School Bus Association, which represents public and private school bus carriers in the Canadian province. However, Laurie says parents should not shirk their responsibility for the welfare of their children. "If my child is 5 years old, I am not going to let him walk to the bus stop by himself, and I cannot expect him to walk from the bus stop to home by himself," she says. "It's inconceivable." Woody FitzMaurice, Vancom/TransPar's general manager of pupil transportation for Chicago Public Schools, agrees. "We all have responsibility, but the primary responsibility for the child's safety at the bus stop is the parents'," he says. "You cannot manage and run a transportation system if the parents have no responsibility for their children." FitzMaurice says school districts routinely inform parents of the division of responsibility, although few require parents to sign a statement to that effect. "As a parent myself, I just cannot abdicate that responsibility to somebody else," he says. "The moment that a school district assumes total responsibility for a child from the time he leaves his house, you're forcing, for liability reasons, every child to be picked up at the front door. It's a horrendously large issue." FitzMaurice says nearly all school districts require an adult to accompany a pre-kindergarten child to the bus stop and meet him there after classes. Some parents, however, believe that their 3- or 4-year-olds can walk two blocks by themselves to meet the bus. "Not if they're getting one of my buses, they're not," FitzMaurice says. "There has to be a line drawn somewhere." nnParents provide buffernnEllen Nelson, terminal manager for Vancom/Laidlaw in South Holland, Ill., says the policy that an adult meet a kindergartner at the bus stop is standard, unless an older sibling is also getting on or off the bus. "Kindergartners are just too little," she says. "The way the world is changing, we just don't want to take that chance. If the parent is there, you can eliminate the opportunity for harm to come to that child from an outside source." Nelson's terminal operates nearly 200 buses to service about half a dozen school districts. One of its clients, Park Kindergarten Center in Riverdale, Ill., recently warned parents that the police or protective services agencies would be contacted if they were late in meeting the child at the bus stop. Dell S. McFarlane, principal of the school, told local newspapers that a handful of parents had been repeatedly late in picking up their children, forcing drivers to return the youngsters to the school. She had stayed with these students as late as 5 p.m., about two hours after dismissal. The policy, she said, was designed to remind parents not to leave children unattended. In addition to growing concerns about the safety of students at bus stops, communities are also searching for ways to protect students who walk to school. In Escondido, Calif., where the vast majority of students don't receive bus transportation, a program called "Safe Walk Home" has been in operation for more than three years. The program uses police-trained volunteers equipped with two-way radios to patrol neighborhood streets in the vicinity of elementary and middle schools, where gang activity is common. "The program works as a strong deterrent," Tina Pope, the founder of the volunteer organization, told the Washington Post. "Anybody lurking out there knows we're here protecting the kids." 'nnWalking school bus'nnA similar program was recently instituted at Chicago Public Schools, where some children on the South Side have been dodging bullets, not bullies, to get to and from school. About 80 parent volunteers, who undergo criminal background checks, have been recruited to escort elementary school children through gang-ridden public housing projects. "There's a lot of gunfire going on," says FitzMaurice of Vancom/TransPar. Using parent escorts as a "walking school bus," he adds, "makes all kinds of sense. It is very productive." The district also has instituted a shuttle service through gang turf for about 150 to 200 students attending two high schools. <title>Reyes Transportation Services: Extensive policy needed to handle DNR orders</title>

<description><![CDATA[ Many parents with severely impaired children have acquired written orders that restrict others from trying to resuscitate their children if they should stop breathing. In nearly every case, the child has multiple physical disabilities and very low mental intelligence. The parents normally make this Do Not Resuscitate (DNR) decision in consultation with the family physician. We do not intend to get into moral issues of DNR orders. Our concern is to help you understand what a school district should do in order to prepare its employees for such an event. Although the state has an interest in preserving life and protecting those who are incompetent, the courts have ruled that under certain circumstances, the family can deny life-sustaining medical treatment based on a constitutional right to privacy and common law. In the 1997 case of Vacco v. Quill, the U.S. Supreme Court ruled that a New York statute that allowed individuals to refuse life-sustaining treatment did not violate the due process clause. nDiscrimination charge dismissednnIn 1994, the legality of schools following DNR orders was challenged by disability advocates, who alleged that a school's choice to honor a DNR order was a civil rights violation of disabled individuals. They claimed that the school district discriminated against the disabled student solely on the basis of the severity of the disability. The advocates claimed that this practice was not being followed for non-disabled students. The U.S. Office of Civil Rights (OCR) ruled that the school's choice to follow the DNR orders did not violate Section 504 of the Rehabilitation Act. The OCR ruled that it was in the realm of the school district's authority to develop an Individualized Education Plan (IEP) that detailed specific measures to be taken in response to certain emergencies, including lifesaving procedures such as resuscitation. In 1990, the Supreme Court addressed the right-to-die issue in Cruzan v. Director, Missouri Department of Mental Health. Noting that many states already had laws addressing this issue, the court said, "We do not think a state is required to remain neutral. . . ." The court also recognized the "liberty interest" of a minor, but did not recognize a minor's right to refuse medical treatment in life-threatening situations. The court implied that while a competent adult may choose to refuse life-sustaining medical care, states have the right to adopt laws that allow them to make life-sustaining decisions on behalf of those who are incompetent or who are minors. nCourt order recommendednnBecause each state may view this differently, we highly recommend that every school district include in its policy a requirement that only those DNR orders accompanied by a court order will be honored. This essentially puts the responsibility for proving the appropriateness of the DNR order upon the parent or guardian. In order to avoid problems with staff not being aware of DNR orders, we recommend that every district have a school board-adopted policy that spells out the procedures to be followed when a parent or guardian presents a DNR order. This policy should include the following:n?  Who must receive the order n?  What information must be provided in the DNR order n?  A timeline for calling an IEP meeting in order to include the DNR order n?  Who will be invited to the DNR meeting n?  How often this IEP objective must be reviewed with the school staff n?  A required court order accompanied by the DNR request Before adopting a DNR policy, your district should have it reviewed by an attorney. <title>Reyes Transportation: Sound Strategies to Reduce Fuel Costs</title>

<description><![CDATA[ Cutting fuel costs is one of the most painless ways of satisfying the harsh budget demands facing many school districts these days. No cutbacks in staff or service are necessary. Rarely does it require significant capital investment. However, harvesting these savings requires planning and legwork. For example, Oceanside (Calif.) Unified School District is constantly on the lookout for lower fuel prices. Transportation Director John Farr says he's trying to secure a deal with the local transit agency, the North County Transit District, for fueling privileges. "They buy in tremendous quantities and receive much better pricing than most," Farr says. "Because of their lower prices, even with a surcharge, it is only a matter of time before we start using their facility." The downside to this accord, however, is that all Oceanside school buses that use the transit filling station would require retrofitting with high-speed filler devices, Farr says. In addition, the transit agency does not yet have a cardlock system, which creates extra paperwork for the school district during the billing process. Oceanside school district fuels most of its vehicles from the 4,000-gallon tank (half diesel and half gasoline) at its bus terminal, but also uses a commercial cardlock fueling station near the local airport. Farr says 14 diesel buses are fueled there, but he plans to increase that number. "For two reasons -slightly lower prices and less congestion in the bus yard," he says. nnStay close to vendorsnnThe Village Bus Co., a Lafayette, N.J.-based contractor that operates 250 school buses, uses a different strategy to keep fuel costs down. President Dennis Hammell says he relies on close relationships with local fuel vendors to minimize his costs. "Sometimes they call me and say, 'Hey, Denny, there's going to be a three-cent fuel increase starting noon tomorrow. If you want, I'll bring you a truckload today,'" Hammell says. "Well, I just saved three cents per gallon on 8,000 gallons." To take best advantage of these opportunities, Hammell says school bus operators need to have adequate storage capacity. Village's main terminal has three 10,000-gallon underground tanks, which provide multiple options for fuel purchasing. "Far and away, that's the best answer, as far as price goes," Hammell says. The company's other three terminals aren't as versatile because they don't have storage tanks. Hammell says the cost of adding a storage tank, even an above-ground unit, would be about $50,000. "It takes a long time to make that up in fuel savings," he says. Another fuel-saving strategy stresses greater utilization. At Kyrene Elementary School District in Tempe, Ariz., ridership increased 54 percent between the 1995-96 and 1996-97 school years (from 6,146 to 9,454), yet the transportation department didn't add a single vehicle to its 78-bus fleet. "It's been a huge cost savings," says Transportation Director Hank Grates. The district helped make it possible by switching to a three-tiered bell system, but transportation did its part by increasing the load factors of its buses. "We're maximizing our fleet to control our fuel costs," Grates says. "Our buses are bursting at the seams." nForm a consortiumnnOne of the most effective methods of lowering the cost of fuel is to buy bulk quantities through a consortium. Four years ago, School District #62 on Vancouver Island in British Columbia, joined with two other school districts, municipalities and a water district to form a joint purchasing commission for fuel, motor oil, antifreeze and other automotive supplies. "We're all looking at how to save a nickel these days," says Transportation Supervisor John Walker. The bulk purchasing arrangement has trimmed fuel costs by approximately 12 cents per gallon of diesel, he says. The overall savings aren't huge because only half of the 28-bus fleet runs on diesel (the other half are propane conversions). Walker says the estimated savings were $7,000 for the 1996-97 school year, but he expects that sum to increase as he continues to add only diesel buses to his growing fleet. "They're doing better than propane on a cost-per-mile and performance basis," he says. In addition to bulk-rate discounts, joint purchasing agreements also provide each member with greater clout. Orchard Park (N.Y.) Central School District buys its fuel through a cooperative bid with the Board of Cooperative Educational Services (BOCES), a regional consortium of school agencies. Transportation Supervisor Gerry Dominski says the joint agreement gives her school district more clout with the fuel vendors over such things as delivery times. "They don't mind making one person unhappy," she says, "but they don't want to make a lot of people unhappy." nnReduce the deadheadnnAt Polk County (Fla.) Public Schools, which uses 444 buses to cover 1,859 square miles, the transportation department significantly reduces its daily mileage by assigning drivers to routes in their own neighborhoods and allowing them to take their buses home. "We don't assign drivers on the north end of the county to routes on the south end of the county," says Arby Creach, supervisor of operations. "That reduces the deadhead mileage and really helps us keep our fuel costs down." It's not a perfect solution, however. Creach says the route assignments can create "ticklish situations" with the drivers union because of seniority issues. In addition, supervisors have less control over their charges. "The drivers really don't have somebody looking over their shoulder every day," Creach says. "It's a tough way to supervise them." Another tactic used to reduce fuel usage is strategic driving. Creach says introductory driver training includes techniques to conserve fuel, such as allowing the bus to glide as much as possible, slowing down in anticipation of red lights and avoiding jackrabbit starts. Minimizing idling time is also a consideration. Hammell of Village Bus Co. says his mechanics start all the buses in the morning and give each vehicle "the bare minimum amount of warmup" before shutting them down. When the drivers arrive to begin their routes, "the buses are still warmed up, but they're not sitting out in the yard running," Hammell says. nnAlternative-fuel costs can be minimized, toonnThe key decisions on how to minimize the operating costs of alternative-fuel school buses should be made before the vehicles are purchased. "More than anything else, this focuses on matching the alternative fuel vehicles to the specific route requirements," says Steve Goguen, a spokesman for the U.S. Department of Energy (DOE). This approach is especially true for compressed natural gas (CNG) buses, which can cost from $10,000 to $25,000 more than their diesel-powered counterparts. Goguen says it's important to use these vehicles on longer routes because the fuel costs are lower (about 10 to 40 cents per gallon cheaper than petroleum-based fuels). The more mileage accumulated, the faster the payback in fuel cost savings. Of course, this push for high daily mileage should be weighed against the useful range of the vehicle. The refueling process for CNG buses can be lengthy, depending on whether fast-fill fueling stations are available. Thus, Goguen says routes should be scheduled to avoid refueling during the school day, which reduces the vehicle's availability and increases labor costs. School bus operators who use propane-powered buses need to be tuned in to the seasonal variation in the fuel's price and availability. "Most school systems could probably reduce their fuel costs somewhat by negotiating fuel supply contracts early in their programs," Goguen says. The length of the contract, he adds, would depend on whether the price is high (suggesting a shorter-term contract) or low (longer term). Training drivers to understand the alternative-fuel vehicle's operating characteristics is also important to reducing costs. Goguen says drivers who are attuned to whether the bus is operating normally can help to avoid costly repair work and downtime by identifying small problems before they become large ones. Finally, all operators of alternative-fuel school buses should investigate the availability of state and federal incentives. According to Goguen, the federal government awards grants to construct refueling stations through the DOE's Clean Cities program. Thanks to communication via the net we are able to cut down on our use of paper and mail services, but should some things remain sacred? Like sending out traditional wedding invitations in the post.<br /><br />I'm sure you must have received at least one email wedding invitation from friends or relatives. I can't speak for everyone, but I prefer it, for a number of reasons.<br /><br />Email wedding invitations are fun, fast, cool and much easier to respond to. Spare me the standard issue traditional wedding invite with hackneyed phrases and graphics. And spare me the hassle of posting back an RSVP. Instead give me something that pops up in my in box with a simple link to RSVP. How much easier is that?<br /><br />Email wedding invitations are much more fun and much more personal. You can choose your own wording and even add music or a graphical presentation to surprise and delight your guests. Forget traditional invites. Put your own together and email them out.&nbsp; Save on postage costs and do your little bit for the environment.<br /><br />There are plenty of reputable sites out there that allow you to design and distribute customised email wedding invitations. Think carefully about the format you use. Pop ups may incur the wrath of spam filters and are best avoided. Make sure your invite comes complete with a print option. People will want hard copy with instructions and directions to take along with them on the big day.<br /><br />Finally consider less tech savvy guests. Your hip young friends and colleagues will have no problem with email, Great Auntie Doris might be another story entirely..</p> ]]></description>

<description><![CDATA[ School bus operators need to have a clear, comprehensive transportation policy to avoid confusion and controversy. An incomplete or outdated policy and procedures manual invites disputes - especially with parents - that can quickly escalate into battles before the school board and headlines in the local newspaper. At Lakewood School District in Lakewood, Wash., the transportation department was involved in a bitter dispute with a parent over the location of a bus stop. The parent had requested that the transportation department move the existing bus stop closer to his home, which was approximately one-quarter mile down a dead-end road. The parent said he was concerned about safety hazards created by a nearby construction project. After a review of the bus stop and a discussion with the construction company regarding the students at the bus stop, the parent's request was denied. Subsequently, the parent brought this dispute to the school board, accusing the district of violating various state laws pertaining to school transportation. Although the media coverage was intense, the school board did not make any decision when confronted by the parent. Instead, the board directed the superintendent to review the matter. While the issue was under review, the media coverage decreased significantly. To settle the dispute, the superintendent requested state pupil transportation officials to conduct a review of the department. The completed review produced a number of recommendations, one of which was to update the transportation policy. This was the most important and beneficial recommendation submitted by the review team. nUnclear policy blamednnIn retrospect, the problem with the parent started, and became worse, because the transportation department did not have a clear policy. In following existing school board policy, it was believed that the transportation department's decisions were proper and consistent. However, it was how the decisions were made that were inconsistent. In this case, there was no appeal procedure, leaving it up to the parent to determine what to do after we turned down his request to move the bus stop. Now, the new policy directs the decision-making process. For example, all requests for transportation changes must be submitted in writing on a single-page form. Previously, requests were taken over the telephone, and responses were usually returned in the same manner. In addition, the parent must clearly state the reason - the what, when and why - for the proposed change. In some cases, parents have chosen not to submit the form because of this section. Although parents are reluctant to admit it, many of their proposed changes are prompted by inconvenience rather than acceptable reasons, such as traffic safety hazards. After the completed form is received, policy and procedures manual guides on how to handle the request. In addition, the form states the time line for response and, if necessary, appeal. With these deadlines in mind, the site is assessed, discussions with the bus driver are held and review compliance with transportation policy is performed. Response to the parent, is always in writing. (This alone has practically eliminated the frustration of arguing the merits of a request over the phone with the parent.) If a parent disagrees with the decision, they may file a written appeal with the district's Transportation Advisory Committee. If the parent is not satisfied with the committee's verdict, he or she must submit a written appeal to the school board and present it in person during a scheduled meeting. nHow to update policynnThe first step in developing or updating your policy is to talk to the person responsible for policy development. Learn what's needed to adopt or modify a policy. Many school districts form an advisory committee, which might include a transportation representative, two or three parents, a principal and a public safety liaison. Other persons could serve in an advisory capacity. Once a committee has completed a recommended policy, the final draft should be reviewed by the school district's lawyers. The approved draft can then be submitted to the community for discussion at a school board meeting. At minimum, the transportation policy should include the following topics:n?  Statement of philosophy: What is the guiding code for your policy? Who is responsible to implement this policy? n ?  Purpose and priorities: What is the paramount objective? For example, is transporting students to and from school more important than field trips? n ?  Eligibility requirements: Who receives transportation? n ?  Routing and bus stops: What roads are serviced? Walking distances? n ?  Appeals: How and when are appeals considered? n ?  Rules and regulations: Affirming school district compliance with state laws. n ?  Communications: How and when are parents and students provided with information? Rules and emergency conditions should be covered. n ?  Co-curricular activities: Definitions and use of district vehicles for these activities. n ?  Use of private vehicles and contractors: Approval requirements for their use. n ?  Advisory committee: Function and composition. nn4 building blocks to good decisionsnnThere are four components to the decision process that must be addressed in order to resolve simple problems before they escalate into full-scale controversies. n1. Authority: Do you have the authority to make all transportation decisions? How is that authority established? Without it, your position in a dispute is compromised and can lead to your being passed over by the person lodging the complaint. When this happens, problems and requests that should be dealt with at your level go directly to your director or superintendent, which can erode their confidence in you.n2. Purpose: Why is one particular decision different from another? You should know what has priority in your school district and what does not. Without priorities, you and your system will soon be perceived as "aimless."n3. Consistency: Without a comprehensive policy, how can your decisions remain consistent? Inconsistent decisions regarding transportation are not only improper and unfair, but they also infuriate parents. It is nearly impossible to track every decision made by you and your staff. By following established guidelines, you ensure consistency. n4. Appeals: How does a parent appeal a decision? Without an appeal procedure, parents are forced to determine their own course of action. This can be a great source of trouble if it takes the form of a public protest or a large, angry crowd at a school board meeting.
